CHARLOTTE, N.C. (AP) — A federal judge on Tuesday issued a key victory for two race teams, one owned by Michael Jordan, that further pressures NASCAR to settle the antitrust lawsuit filed against it by 23XI Racing and Front Row Motorsports. 
NASCAR Commissioner Steve Phelps said last week the series is <a href="https://apnews.com/article/nascar-lawsuit-phelps-settlement-df611f601fb50544d79d67ea1c9c1d69">“trying our hardest”</a> to settle <a href="https://apnews.com/article/nascar-lawsuit-b0aaf3b03a5896ff3f341930312c743a">the federal antitrust lawsuit</a> with the two teams suing in the most expansive comments yet from the defendants.
U.S. District Judge Kenneth Bell ruled Tuesday in favor of 23XI, owned by Jordan and three-time Daytona 500 winner Denny Hamlin, and Bob Jenkins-owned Front Row, on an argument over the market definition of “premier stock-car racing." Bell found that NASCAR controls the market and NASCAR's argument that teams can race in other series is moot.

The teams said in alleging the relevant market for premier stock car racing teams that “NASCAR’s Cup Series is currently the only buyer.” The argument was backed by the the expert opinion of Dr. Daniel Rascher, who concluded that “premier stock car racing” is a distinct form of automobile racing, and other types of motorsports like Formula 1 and IndyCar, and all lower levels of stock car racing, are not an equal substitute to NASCAR.
NASCAR in a counterclaim said the teams unlawfully conspired in banding together for negotiations on new charter agreements, but Bell found "NASCAR deliberate(ly), clear(ly) and unambiguous(ly)” alleged that the relevant market is “the market for entry of cars into NASCAR Cup Series races in the United States and any other location where a Cup Series race is held.”
“The same transaction – the sale and purchase of premier stock car racing services – cannot be a different relevant market depending only on which side is complaining,” Bell wrote. “Most simply put, NASCAR made a strategic decision in asserting its Counterclaim and must now live with the consequences.”
The lawsuit was filed a year ago by 23XI Racing and Front Row Racing when they were the only two organizations out of 15 to not sign extensions on new charter agreements. 
The new charter agreements were presented to the teams at the start of the 2024 playoffs with a deadline for them to sign. It followed more than two years of tense negotiations over the charters, which are at the heart of NASCAR’s business model as they guarantee revenue and access to weekly races.
23XI and Front Row likely will go out of business without them and are racing this season unchartered, which comes with significantly reduced prize money.
Other teams have called for a settlement to move forward, but mediation sessions and private negotiations have not worked. The trial is scheduled for Dec. 1.
“We are very pleased with the Court’s decision today, ruling in our favor. Not only does it deny NASCAR’s motion for summary judgment, but it also grants our partial summary judgment motion, finding that NASCAR has monopoly power in a properly defined market," said Jeffrey Kessler, the attorney representing 23XI and Front Row. 
"This means that the trial can now be focused on whether NASCAR has maintained that power through anticompetitive acts and used that power to harm teams. We’re prepared to present our case to the jury and are focused on obtaining a verdict that benefits all of the teams, partners, drivers, and the fans.”
NASCAR in its own statement touted the commitment it has shown into building NASCAR into the top motorsports series in the United States since its 1948 formation. Phelps did the same last week while reading from a statement that ran more than six minutes; he defended the Florida-based France family who founded and controls NASCAR and most of the tracks the series uses for events. 
“NASCAR looks forward to proving that it became the leading motorsport in the United States through hard work, risk-taking, and many significant investments over the past 77 years," NASCAR said in a statement. "The antitrust laws encourage this — and NASCAR has done nothing anticompetitive in building the sport from the ground up since 1948. 
"While we respect the Court’s decision, we believe it is legally flawed and we will address it at trial and in the Fourth Circuit if necessary. NASCAR believes in the charter system and will continue to defend it from 23XI and Front Row’s efforts to claim that the charter system itself is anticompetitive.”
Most of the organizations that did sign the new charter agreements last year submitted declarations to the court in support of the charter system and calling for a settlement to the case. All the teams want the charters to become permanent, which NASCAR refused to budge on during negotiations for the current agreement. 
Should a settlement not be reached before the trial and NASCAR loses, the entire charter system is at risk of being disbanded or overhauled. Teams are frustrated by that threat, and it is understood that NASCAR has since agreed to make the charters permanent and the snag in settlement talks is the amount of money 23XI and Front Row is demanding in damages and legal fees.
Teams are concerned that NASCAR's entire framework could be torn apart by a loss and are aggravated that it would be over the monetary demands being made by 23XI and Front Row. 
Bell last week issued another win for 23XI and Front Row when he <a href="https://apnews.com/article/nascar-antitrust-lawsuit-jordan-f961b36a7b8038bc895d045ce26c3005">dismissed NASCAR’s countersuit against Curtis Polk,</a> the longtime business manager for Jordan and one of 23XI’s owners.

At halftime, he was 16 for 16 for 282 yards and four TDs against Washington’s beleaguered defense. Rookie Tory Horton had the first two touchdown catches for the Seahawks, and even practice squad elevation Cody White got in on the action before the half was over. It was 31-7 at halftime.<div class="the-score-article-ad-unit"></div>Seattle (6-2) remained tied with the Los Angeles Rams atop the NFC West. The Seahawks were without injured receiver Cooper Kupp, but Darnold had plenty of open teammates to throw to. (AP) — Kyle Larson knew he wasn’t going to catch Denny Hamlin in the final laps on Sunday, not without the sort of help that only a caution flag can bring.Larson got his lucky break.Hamlin only got heartbreak.<div class="the-score-article-ad-unit"></div>Larson is now a two-time NASCAR champion after denying Hamlin what would have been his first career title when a late caution at Phoenix Raceway sent the championship-deciding finale into overtime.Without that caution, which came with three laps to run, Hamlin had it locked up and was ready to finally shed the label of greatest NASCAR driver to never win a championship. But fellow title contender William Byron got a flat tire and hit the wall to bring out the caution, and a few minutes later, it was over."Just unbelievable," Larson said. "I cannot believe it."Neither could Hamlin."I really don’t have much for emotion right now. Just numb about it ’cause just in shock," Hamlin said after consoling his crying daughters on pit road. "We were 40 seconds away from a championship. This sport can drive you absolutely crazy because sometimes speed, talent, none of that matters."When the caution for Byron came out, Hamlin led the field down pit road and got four new tires on his Toyota; Larson only took two tires on his Chevrolet. It meant Larson was fifth for the two-lap sprint to the finish, with Hamlin back in 10th.With so little time to run down Larson, Hamlin came up short with a sixth-place finish as Larson finished third. Ryan Blaney, who was eliminated from title contention last week, won the race."You do have to feel for that group and Denny. Doing a good job all day, it not playing out for him. But that is racing. It sucks sometimes," Blaney said. "They can hang their head about it, but they should be very proud about the effort. They had the fastest race car here. Just one of those things where it doesn’t work out. Looked like it was going into his favor, unfortunately for him, it didn’t."It is the second championship for Larson, who won his first title in 2021 when he joined Hendrick Motorsports. It is the 15th Cup title for the organization and came on the 30th anniversary of Jeff Gordon giving Hendrick its first championship in 1995.As Larson celebrated, Hamlin sat in his car motionless for several seconds, then wiped his face with a white towel, never showing any emotion.Larson, who has been in a slump since his disastrous Memorial Day attempt to race both the Indianapolis 500 and Coca-Cola 600 on the same day, was also in shock."We didn’t lead a lap and won the championship," Larson said. "We had an average car at best and had the right front (tire) go down, lost a lap and got the wave around, saved by the caution with the wave around. It’s just unbelievable. What a year by this motorsports team."Team owner Rick Hendrick, Gordon and Larson crew chief Cliff Daniels all said they did not believe Larson still had a chance at the championship after so many problems during the race."I have to acknowledge that it was a pretty ugly day for us," Daniels said. "I think we were beat on raw pace, and after we had the flat tire, there wasn’t a lot of good things coming our way. The way the team stuck together and continued to believe in each other, Kyle continued to believe if we just had a shot we could close it out."When Hamlin finally got out of his car he embraced his crew members but it was a scene of disbelief among the Joe Gibbs Racing crowd. Team members were crying, some sitting in shock on the pavement, Gibbs himself stood silent, one hand on his hip and a look of disbelief on his face.It is the sixth shot at a title to slip away from Hamlin in his 20 years driving for Gibbs. He led 208 of the 319 laps and started from the pole."Nothing I could do different. I mean, prepared as good as I could coming into the weekend and my team gave me a fantastic car," Hamlin said. "Just didn’t work out. I was just praying 'no caution' and we had one there. What can you do? It’s just not meant to be."He said crew chief Chris Gayle made the correct call with four tires, but too many others only took two, which created too big of a gap for Hamlin to close on Larson in so little time.The 44-year-old Virginia native had been extremely jinxed in five previous championship finales, with bad luck, bad strategy and bad cars breaking his heart in 2010, 2014, 2019, 2020 and 2021. Sunday marked his first time eligible in the winner-take-all race in four seasons.Hamlin was remarkably loose and calm all week, rented three houses in Scottsdale for 30 friends and family, won the pole and then dominated Sunday’s race.He was the sympathetic favorite, the betting favorite, and who most of the industry was pulling for - largely based on how much heartbreak he has faced. Hamlin burst onto the NASCAR scene in 2006, winning rookie of the year and finishing third in the championship.On many levels, that promise has been fulfilled with 60 victories, three of them Daytona 500 wins. On the championship level, it still has not.He had a 15-point lead over Jimmie Johnson going into the 2010 finale but was in a terrible mental space, struggled the entire weekend and spun in that race. Johnson wound up winning his fifth straight title, and Hamlin settled for second.He had a bad pit stop in 2014, overheated because the team put too much tape on the front grille in 2019, and a caution late in the 2021 finale doomed his chances that year. Ross Chastain’s infamous wall ride in 2022 bumped Hamlin from the Championship 4 by mere inches at the finish, and now, this."Man, if you can’t win that one, I don’t know which one you can win," Hamlin said of his latest defeat.Larson was OK during the race, but hasn’t won since early May, a slump that has now extended to 24 consecutive races.Hamlin teammate Chase Briscoe finished 18th in his debut in the championship finale, while Larson teammate Byron was 33rd after his late issue. He felt awful for ruining Hamlin’s chance even though his Hendrick Motorsports teammate won the championship."I’m just super bummed that it was a caution obviously. I hate that. Hate it for Denny. I hate it for the 11 team," Byron said. "I mean, Denny was on his way to it. I hate that. There’s a lot of respect there. I obviously do not want to cause a caution. If I had known what tire it was, known that a tire was going down before I got to the corner, I would have done something different."

PITTSBURGH (AP) — Jaylen Warren ran for two touchdowns, and the Pittsburgh Steelers forced Indianapolis into six turnovers in a 27-20 victory on Sunday.The Steelers (5-3) snapped a two-game losing streak by harassing Colts quarterback Daniel Jones into the kind of mistakes he’d largely avoided during Indianapolis’ scorching-hot start.Jones threw three interceptions and fumbled twice, including a strip-sack by Pittsburgh’s T.J. Watt in the second quarter that seemed to shake the Steelers out of a weeks-long funk in which the NFL’s highest-paid defense gave up yards and points at an alarming rate.<div class="the-score-article-ad-unit"></div>Watt’s recovery, which came with the Steelers trailing by a touchdown and looking lifeless and on the receiving end of a smattering of boos from an uneasy Acrisure Stadium crowd, set up the first of Warren’s two touchdown runs and started a familiar pattern. Pittsburgh’s defense would take it away, then Aaron Rodgers and the Steelers’ offense would convert that turnover into points.Pittsburgh turned three of Indianapolis’ giveaways into touchdowns during a stretch in which they ripped off 24 straight points to take control.Two snaps after Warren’s plunge tied it, Jones threw an ill-advised pass right to Steelers linebacker Payton Wilson, who returned it 17 yards. Taylor, the NFL’s leading rusher, was held to a season-low 45 yards on 14 carries and was an afterthought even during the first half, when he ran it just eight times while Jones attempted 20 passes with diminishing results.Indianapolis remains atop the AFC South despite the stumble. Pittsburgh remains the only team in the AFC North with a winning record.
